Not exactly the same thing, but a few years ago my cousin was driving down a busy street in Detroit and hit a three-year-old kid. She was standing in the median for some reason, and he saw her, but she decided to make a run for it right in front of my cousin's car. In Michigan, the law pretty much always sides against the driver if they hit a pedestrian, so he got the ticket, which would've put him on the hook for the kid's medical expenses and all that, plus vehicular manslaughter if she died.
The parents were nowhere to be found, so my cousin got a lawyer and fought the ticket on the grounds of "what was a three-year-old kid doing in the middle of Woodward Avenue in the first place, and where the fuck were her parents?" He won. Also, the kid was fine (she "bounced" off the front of his car back onto the median but was otherwise unhurt).
