My theory:

They chose a guy with an already signed contract with another label. Either they're waiting for the contract to expire or they're trying to cancel it, Meanwhile, they already booked a studio so they have to use it. The new guy is not there. Only Jordan, James and the John's are there jamming. They send every day their fresh material to the new guy for him to add ideas and be ready to record the drum parts for the final mix. It's all a legal issue. People's jobs are on the line here.

JP's recent interview where he stated something along the lines of...This is much deeper than you know...leads me
to believe that there are probably multiple issues weighing this process down.

A part of me wonders if the band knew then what they know now...would they have made the same choice?

Well it shows they are willing to stick by him through all this. I'm sure it will all be resolved eventually and then they will be glad they made the choice they did.

It almost has to be Mike Mangini. Every other famous drummer has been confirmed in an interview or through credible word of mouth that they either didn't audition or didn't get the job. Mangini's recording with another band, but they haven't announced he's been permanently hired. This also squares with him not being in the studio with the band. When one of his students asked about whether he got the Dream Theater gig, he didn't answer and tensed up.

I don't see what else it can logically be.

I was thinking, if it is Mangini then you just know in the press release from RoadRunner it will make reference to MM having won the title of 'fastest drummer in the world' as if that was a main factor in the band choosing him. Not a big issue, but that would irritate me.

Pretty much this. But, as I said, at this point, they may not even announce it until there's a sneak-peak at the album, or until the first single is released. Of course, if they way til then, there will likely be a video, which would be a GREAT way to literally SHOW off the new drummer.

Personally, at this point, I can wait a little longer til we get the first single, which will likely be around May or June at the rate they are going.

Not sure why everyone thinks he's not with them. Just because they haven't said he is, doesn't mean he isn't. It would just cause more fuss if they said he was there.

It would be funny if JR did an iPhone video and was really casual about it, "Hey guys, what's up? Just wanted to show you around the studio, here's my eigenharp rig it's pretty good, this is my keyboard we've got some great songs around this Snarling Fucking Pig sound. Here's John Petrucci ('What's up guys?') and John Myung (...). You all know Paul Northfield hiding behind the computer there, and here's Rich Chycki who's mixing for us. Over here we've got Mr. Bosk, who is our new drummer (*smiles and waves*). Well that's pretty much it, it's really going great so far and we'll see all of you... on the road."
